Terms of Service
Last updated: YYYY-MM-DD · Effective: YYYY-MM-DD
These Terms of Service ("Terms") govern your use of the Shopvolt Shopify app and related services ("Service") provided by [insert legal entity name] ("Shopvolt", "we", "us", "our"). By installing or using the Service, you ("Merchant", "you") agree to these Terms.
If you do not agree to these Terms, do not install or use the Service.
1. The Service
Shopvolt provides a Shopify app that lets Shopify merchants configure and run bundle offers on their storefronts. The Service includes:
- A configurable bundle widget that renders on product pages via a Shopify Theme App Extension.
- A Shopify Discount Function that applies bundle discounts at checkout.
- An analytics dashboard reporting bundle performance.
- Optional features including multi-language translations, Markets targeting, and supplementary modules.
We may update, modify, or improve the Service at any time. Material changes that reduce functionality will be communicated in advance where reasonably possible.
2. Account & Eligibility
To use the Service you must:
- Have an active Shopify store.
- Install Shopvolt through the Shopify App Store.
- Be authorized to enter into these Terms on behalf of yourself or the business operating the store.
- Comply with Shopify's Terms of Service and Acceptable Use Policy.
If the Service is used through a Shopify Plus organization, the organization's principal account holder is responsible for all use of the Service across stores in that organization.
3. Pricing & Billing
The Service is billed through Shopify's billing API. Plan tiers, prices, and any usage-based components are described on our pricing page and within the Shopify App Store listing.
- Free tier (Starter) — no charge, subject to the limits stated on the pricing page.
- Paid tier (Growth) — billed monthly through Shopify. The plan auto-renews until cancelled.
- Trial periods, if offered, automatically convert to a paid plan at the end of the trial unless cancelled.
You can change or cancel your plan at any time from within the Shopify admin. Cancellations take effect at the end of the current billing period.
4. Refunds
Charges are billed in advance and are non-refundable except where required by law. If you believe you've been billed in error, contact support@shopvolt.io within 14 days of the charge.
5. Acceptable use
You agree not to:
- Use the Service in any way that violates applicable law or Shopify's terms.
- Configure bundles to misrepresent prices, discounts, or savings to consumers.
- Use the Service to sell goods that violate Shopify's prohibited business policies.
- Attempt to reverse-engineer, decompile, or extract source code from the Service except where permitted by law.
- Use automated means (scrapers, bots) to access the Service in ways that adversely affect its performance.
- Resell, sublicense, or expose the Service as your own product without our written agreement.
6. Your content
You retain all rights to the content you supply to the Service (product information, deal configurations, translations, custom CSS, images). You grant Shopvolt a non-exclusive, worldwide, royalty-free license to host, store, and process that content solely for the purpose of providing the Service.
You are responsible for ensuring you have the rights to all content you use with the Service, and for the legal compliance of the offers you run (including local consumer-protection rules, comparative pricing rules, and tax implications).
7. Our intellectual property
Shopvolt, our logos, the Service code, designs, and documentation are owned by us and our licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers ownership of our intellectual property to you.
8. Shopify and third-party services
The Service depends on Shopify and on third-party providers (hosting, error tracking) to operate. We are not responsible for outages, changes, or limitations of those services. Our Service is subject to Shopify's API rate limits, platform availability, and policy decisions.
9. Disclaimer of warranties
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, and uninterrupted availability.
We do not warrant that the Service will increase your revenue, conversion rate, or any other business metric. The "added revenue" and "applied rate" metrics surfaced in our dashboard are best-effort attribution estimates and should not be relied upon as accounting figures.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Shopvolt, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
Our total aggregate liability arising from or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) [USD 100 — adjust per legal advice].
Some jurisdictions don't allow exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify and hold Shopvolt harmless from any claim, loss, or liability (including reasonable legal fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) the bundle offers, prices, or representations you make to your customers using the Service, or (c) any content you provide.
12. Suspension and termination
You can stop using the Service at any time by uninstalling the app from your Shopify admin. Upon uninstall, your account data is deleted as described in our Privacy Policy.
We may suspend or terminate your access if you breach these Terms, abuse the Service, or in response to a legal obligation. Where reasonable, we will provide notice and an opportunity to cure.
13. Changes to these Terms
We may revise these Terms from time to time. For material changes, we'll notify installed merchants by email and update the "Last updated" date at the top. Continued use of the Service after a change constitutes acceptance.
14. Governing law & disputes
These Terms are governed by the laws of [your jurisdiction — e.g. France, Delaware, etc.], without regard to conflict-of-law rules.
Disputes arising from these Terms will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to the exclusive jurisdiction of the courts of [your jurisdiction], except where mandatory consumer-protection laws of your jurisdiction provide otherwise.
15. Miscellaneous
- Entire agreement — These Terms and the Privacy Policy are the entire agreement between you and Shopvolt regarding the Service.
- Severability — If any provision is found unenforceable, the rest remain in effect.
- No waiver — Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment — You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Notices — Notices to you may be sent to the email associated with your Shopify store. Notices to us should be sent to support@shopvolt.io.
